1. General provisions
By this public offer, Evgeniya Zakharova, registered self-employed (professional income tax payer), INN 550147868909 (the “Seller”) offers any individual (the “Buyer”) to enter into a distance sale agreement on the terms set out below.
This English version is provided for information. In case of discrepancies, the Russian version prevails. The offer is governed by Articles 435, 437 and 497 of the Civil Code of the Russian Federation, the Russian Consumer Protection Law and the Retail Sale Rules approved by Government Decree No. 2463 of 31 December 2020.
By paying for an order, the Buyer confirms that they have read and fully accept the terms of this offer.
2. Definitions
- Website — https://babenki-decor.ru and all its pages.
- Product — handcrafted interior artworks and panels shown in the website catalogue, as well as items made to the Buyer’s individual specification.
- Bespoke order — a Product made to the Buyer’s parameters (size, colour, composition, sketch) with individually defined properties.
- Order — the Products, parameters, price, production time and delivery terms agreed by the parties.
3. Subject of the agreement
The Seller undertakes to transfer the Product to the Buyer, and the Buyer undertakes to accept and pay for it under this offer and the agreed Order.
Product images on the website are for information only. Each Product is handmade from natural materials, so minor differences in shade, texture and pattern from photographs, sketches or renderings, as well as differences caused by screen colour reproduction, are possible and are not defects.
4. Placing an order
The Buyer places an Order by contacting the Seller via WhatsApp, Telegram or telephone as listed on the website, including through the “Order” button on a product page.
The Seller agrees the contents of the Order, size, price, production time and delivery method and cost with the Buyer. For a bespoke order, the Seller agrees a sketch or rendering with the Buyer before production starts.
The agreement is concluded once the Order is paid in full or the agreed prepayment is made.
5. Price and payment
Prices on the website are in Russian roubles. “From” indicates the minimum price; the final price depends on size and parameters and is fixed when the Order is confirmed.
Delivery is not included in the Product price; it is calculated individually and communicated to the Buyer before payment.
Payment is made by bank transfer using the details or payment link provided by the Seller when the Order is confirmed. Bespoke orders are made after a prepayment agreed at confirmation; the balance is paid before dispatch.
The Seller issues a receipt to the Buyer as required by Russian law.
6. Production time and delivery
In-stock Products are dispatched within the time agreed at Order confirmation. The production time of a bespoke order is agreed individually and runs from the prepayment and sketch approval.
Products are delivered by transport or courier companies within Russia and abroad. The delivery method is agreed with the Buyer; delivery costs are borne by the Buyer unless agreed otherwise.
Ownership and the risk of accidental loss or damage pass to the Buyer when the Product is handed over to the Buyer or a person they designate.
On receipt, we recommend checking the packaging and the Product in the presence of the courier. Any damage should be recorded in the carrier’s documents, photographed and reported to the Seller.
7. Returns and exchanges
The Buyer may refuse an in-stock Product of proper quality at any time before handover and within 7 days after handover, provided its condition, consumer properties and proof of purchase are preserved. If written information on the return procedure was not provided at delivery, this period is 3 months from handover.
A Product of proper quality made to a bespoke order with individually defined properties cannot be returned or exchanged (Article 26.1(4) of the Russian Consumer Protection Law). If the Buyer cancels a bespoke order before handover, they reimburse the Seller’s actual costs incurred.
If the Buyer refuses a Product, the Seller refunds the amount paid within 10 days of the request, less the Seller’s costs of returning the Product from the Buyer.
If a Product is defective, the Buyer may exercise the rights set out in Article 18 of the Russian Consumer Protection Law in accordance with that law.
To arrange a return or exchange, the Buyer contacts the Seller using the details in section 11.
8. Liability
The parties are liable for failure to perform their obligations in accordance with Russian law.
The parties are released from liability if non-performance is caused by force majeure. The affected party notifies the other party within a reasonable time.
9. Personal data
The Seller processes the Buyer’s personal data to perform the agreement in accordance with the Privacy policy published at https://babenki-decor.ru/en/personal-data.
10. Disputes and final provisions
Disputes are resolved through negotiation. Claims are sent to the Seller in writing or via the messaging services listed in section 11; the Seller responds within 10 days of receipt. Unresolved disputes are referred to court in accordance with Russian law.
The agreement is governed by the law of the Russian Federation.
The Seller may amend this offer. A new version takes effect when published on the website and does not apply to Orders paid before its publication.
